NexiaNect

NexiaNect is a software and technology company developing intelligent operational systems for export agriculture, including CIBYR OS and its associated technology and services.

For purposes of applicable data-protection legislation, NexiaNect may act as a responsible party when determining the purposes and means of processing personal information, and may act as an operator/service provider when processing information on behalf of a customer.

Depending on how you interact with NexiaNect, we may collect information such as:

  • Name, surname and business/company information.

Customer & Operational Data

Where NexiaNect provides software or services to an organisation, that organisation may provide, upload or generate information through the relevant system. In such circumstances, the customer may determine the purpose for which that information is processed.

Customer data remains subject to the applicable commercial agreement. NexiaNect will not use customer operational data for unrelated purposes except where permitted by the applicable agreement or law.

The structure, configuration, software, architecture and underlying technology of NexiaNect systems may remain the intellectual property of NexiaNect or its licensors, while information supplied by a customer remains subject to the customer's applicable rights.

Security Safeguards

NexiaNect takes reasonable technical and organisational measures to protect personal information against loss, damage, unauthorised access, unauthorised disclosure and unlawful processing.

10 / SECURITY INCIDENTS

Data Breaches & Security Incidents

If NexiaNect becomes aware of a security compromise involving personal information, we will assess the incident and take reasonable steps to contain, investigate and remediate it.

Where applicable law requires notification to an affected data subject or regulator, NexiaNect will provide notification in accordance with the relevant legal requirements and within the applicable statutory timeframe.

11 / RETENTION

How Long We Keep Information

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, to fulfil contractual or legal obligations, resolve disputes, maintain business records, enforce agreements or protect legitimate interests.

Retention periods may therefore differ depending on the nature of the information and the relationship with NexiaNect.

Where information is no longer required and there is no legal or legitimate reason to retain it, reasonable steps will be taken to delete, destroy or de-identify it.

Where NexiaNect sends direct electronic marketing communications, we will do so in accordance with applicable law and the permissions or exemptions that apply to the relevant communication.

You may request that we stop sending marketing communications to you. Transactional, security or service-related communications may still be sent where necessary.

Children's Information

NexiaNect's website and services are directed primarily toward businesses, professionals and organisations. We do not knowingly seek to collect personal information from children for purposes that are unlawful or inappropriate.

If you believe that a child has provided personal information to us without appropriate consent, please contact us so that the matter can be assessed and addressed.

International Service Providers

Some technology, hosting, communications, analytics or infrastructure providers used by NexiaNect may operate outside South Africa.
